The content of the notice letter is prescribed, not discretionary. A letter missing a required item is a defective notice even if it was mailed on time. Tex. Occ. Code §2303.153 sets the list.
The required items
- The date the facility accepted the vehicle.
- The date of the first day for which a storage charge accrues.
- The daily storage rate and the total amount of charges accrued.
- A description of the vehicle (year, make, model, VIN or license plate).
- The facility name, street address, and hours a person may claim the vehicle.
- The facility’s TDLR vehicle storage facility license number.
- A statement of the person’s right to claim the vehicle and the consequences of failing to claim it, including disposal.
